Terms of Service

These terms govern your organisation's use of Lykha, a business management system operated by Anido Creatives Web Development Services ("we", "us"), with its principal office at 3F, 1900 Session Road Building, Session Road, Baguio City, Philippines. By creating a workspace you confirm you are authorised to accept these terms on behalf of your organisation ("you").
1. The service
Lykha provides tools for managing clients, projects, invoicing, expenses, accounting, employees, attendance and payroll. We provide the software; the records you keep in it are yours. Features are added and changed over time. We will not remove a feature your plan depends on without reasonable notice.
2. Your account
You are responsible for the accounts in your workspace, including keeping credentials confidential and removing access for people who leave. The person who creates a workspace is its primary administrator and controls who else may sign in. You must give accurate registration details and keep your contact address current — it is how we reach you about billing, security and service changes.
3. Plans, fees and billing
Paid plans are billed in advance on the cycle shown when you subscribe. Fees are in Philippine pesos and exclusive of any taxes we are required to collect. Seat and capacity changes take effect on your next billing cycle. We may change pricing with at least 30 days' notice before it applies to you; continuing to use a paid plan after that is acceptance of the new price. Fees already paid are not refundable except where required by law.
If an invoice remains unpaid we may restrict access to your workspace until it is settled. We will not delete your data for non-payment without notice and a reasonable opportunity to export it.
4. Acceptable use
You may not use Lykha to break the law, infringe anyone's rights, store material you have no right to hold, attempt to gain access to another workspace, interfere with the service's operation, or resell access without our written agreement. We may suspend a workspace that poses a security or legal risk, and will tell you why.
5. Your data
You retain ownership of everything you put into Lykha. We process it to operate the service and as described in our Privacy Policy. Where your records contain other people's personal information — your employees, your clients — you are the personal information controller and we act as your personal information processor under the Data Privacy Act of 2012 (RA 10173). You are responsible for having a lawful basis to collect and enter that information.
You can export your data at any time while your workspace is active. If your workspace closes, we retain your data for 30 days so you can change your mind or complete an export, after which it is permanently deleted.
6. Availability
We aim to keep Lykha available continuously, but we do not promise uninterrupted service. Maintenance, third-party outages and events outside our control can cause downtime. We take regular backups; you remain responsible for keeping your own copies of records you cannot afford to lose, particularly statutory records you are required to retain independently.
7. Accounting, payroll and tax
Lykha helps you record and compute figures, including statutory contributions and taxes. It is a tool, not professional advice. Rates, thresholds and forms change, and correctness of what you file remains yours and your accountant's responsibility. You should verify computed figures before relying on them for a statutory filing.
8. Liability
To the extent the law allows, our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim arose. We are not liable for lost profits, lost data you could have exported, or indirect losses. Nothing here limits liability that cannot be limited by law.
9. Ending the agreement
You may close your workspace at any time from your billing settings. We may end this agreement on 30 days' notice, or immediately if you materially breach these terms. On termination, section 5's retention and deletion terms apply.
10. Changes
We may update these terms. If a change is material we will notify you and ask you to accept the new version before continuing. The version and date at the top of this page always shows what currently applies.
11. Governing law
These terms are governed by the laws of the Republic of the Philippines. Disputes are subject to the courts of Baguio City, without prejudice to any right you have to bring a complaint before the National Privacy Commission or another regulator.
